    Abstract: 行政訴訟之裁判基準時,指某一提交予行政法院審理之行政訴訟事件,自事件紛爭之發生至法院作成實體判決前,發生事實或法律狀態有變動時,法院應以何時點下之事實或法律狀態為基礎作成裁判之謂。此一裁判基準時之判斷問題,涉及我國行政訴訟制度,在現行憲法之權力分立設計下,應如何妥適達成其制度目的—即人民權利之保障與行政權之合法行使此一基本問題。\\r關於行政訴訟之裁判基準時問題,學說主要有處分時說與判決時(或言詞辯論終結時)說,二種學說均採「原則/例外」模式,但因二學說實際上均承認諸多例外情形,因此,二說實際上並無法提供一明確且具有可操作性之標準。\\r對此,本文在重新檢討憲法規定之權力分立要求後,基於有效權利保護要求、訴訟經濟、紛爭之一次解決必要性、以及妥適調整分配現行各種訴訟類型與既有相關行政法制間之功能分擔觀點,主張除個別法律別有規定或現行法制另有設計外,宜逕自以判決時說為行政訴訟之裁判基準時,而不承認其他例外情形。最後,本文並試圖自「行政法律關係論」之觀點,檢視本文所採標準在理論上之妥當性。
    Judgment standard time in administrative litigation refers to the events and legal facts at the time on which the court should base its judgment. The main concern of this issue is how to achieve the goals of Taiwan’s administrative system-to protect the human rights and legitimacy of administrative powers. There are two theories for the subject: one is related to the making of administrative orders; the other concerns verdicts (when the oral debate is competed). However, both theories admit many exceptions to the rule, rendering them ambiguous and unsuitable to practical application. Accordingly, this paper examines the constitutional principle of the separation of powers, and makes the following conclusions from the viewpoints and the principles of citizen rights’ protection, the economic aspects of litigation, the need to solve disputes at one time and the functionality analysis of the litigation and administrative systems. This paper proposes that the judgment standard time should coincide with the time when the verdict is made without exception. Furthermore, this paper focuses on the point of view of the legal relationship of administrative law to illustrate the feasibility of the verdict-made theory.
