    Abstract: 本論文以在數位時代裡如何維護其特有的知識生產模式,和促成學術資源開放分享此一分析作為出發點,探究採取開放近用型態的學術期刊(open access journals)的出現和維持,必須以哪些基本條件為前提,以及其所面對的規範議題。本論文首先以美國法學期刊編輯出版模式作為主要的探討實例,探討開放近用型期刊可以從美國法學期刊的編輯出版經驗中獲得哪些啟示,作為克服開放近用型期刊困境的參考。其次,本論文也探討大學及研究機構圖書館的自我典藏政策和著作權政策,應該透過怎樣的規範安排,由大學和研究機構保留其對教授及研究者研究成果產出論文的再出版權利。本論文主張,除了學術期刊的編輯出版模式考慮作某種程度的修正,可以有助於學術資源開放分享運動的進展之外,在著作權體制下思考學術資源如何開放分享,以便增進公共利益時,本論文也認為我們不應該輕忽中介機構(intermediate institutions)——也就是大學、研究機構和圖書館在從事數位化典藏和傳播面向所扮演的重要角色。以此重構數位時代的學術資源開放分享的面貌,我們或許才能找到數位時代裡的知識生產成果得以傳播的活路。
    This article examines how the particular knowledge production model and open access movement have developed in the digital age. It first explains the reasons behind the emergence and management of open access journals, and seeks to understand the legal issues they have faced. This article takes the traditional publications model of American law school journals as an example to explore what the most pressing questions are for open access movement. Secondly, this article observes the self-archiving policy and copyright policy adopted by libraries at most universities and research institutes. It then discusses why universities and research institutes reserve the re-publication rights on its faculty’s research output could advance the open access of academic resources and serve the public interest In addition to suggesting some arrangements in publications model of academic journals, this article also underlines the importance of the intermediary role played by uni-versities, research institutes, and libraries in digital archiving and knowledge dissemination. Reconstructing the outlook of open access in academic resources from this approach, we will then find the way to fulfill the potential of knowledge production in the digital age.
