Abstract:	在美國的社會保險制度中，職業災害補償制度為其制度型態之一，其主要對象是針對遭受職災傷病、失能、死亡的勞工和其受撫養遺屬，提供現金以及醫療給付，同時，受領之後即不得再向雇主主張侵權行為之索賠。\\r本文試圖透過對美國職業災害勞工補償制度之歷史、制度架構、適用範圍、給付項目、申訴程序、特別基金、職災預防效果、經驗費率、工會的影響、健康照護組織的角色和聯邦政府的相關措施等分項，來簡介美國制度的立法背景以及其運作概況。\\r最後，本文論及美國因為其法制設計，使的各州有不同的立法內容，形成不同的給付標準和內涵，造成同是職災，各州卻有不同處理方式的問題，因此現在各州有把職災制度交由聯邦政府統一處理的傾向。
