    Abstract: 借用他人土地建屋的情形，土地與土地上之房屋，自始即非屬同一人所有，當事人之間僅有債之關係之使用借貸契約作為利用權源，當嗣後有一方將其標的物之所有權讓與第三人時，基於使用借貸契約的相對性，房地分離下的產權衝突再度發生，究竟土地所有人可否對房屋所有人訴訟拆屋還地，是近來實務上的重要爭議問題，基於房屋的價值性與社會經濟利益，法院試圖調和房地所有人之利害關係，從類推適用租賃之規定，到援引誠信原則與權利濫用禁止作為解決問題之依據，均可見法院努力上的用心，學說上對此也尚未有一致共識。本文從實務判決與學說意見，討論處理本爭議問題的法律適用。基於私法自治，對於房地分離嗣後處分之風險，不管是土地讓與還是房屋讓與，當事人都還有預為防免的可能性，因此，有無法律保護的急迫性，非無疑問，故應儘量減少法院介入的空間，予以例外從嚴。
