    Abstract: 判斷案件先由事實分析為起點,包括主觀與客觀的犯罪事實(更精確的法學用語:構成要件事實)。就本案觀察,與刑法關聯者,張三主觀心理層面認識的客體有:一、一隻狗;二、狗為鄰居李四所養;三、木棍;四、毆打;五、狗腿可能會斷;與張三行為相關的客觀事實為:一、以木棍打狗;二、打斷一條狗腿。接著由這些事實為基點,尋找可能相關的刑法法條。因為設立刑法的主要目的在於保護法益,所以由受侵害的法益種類,可以幫助尋找出相關法條。
