    Title: 談教育基本法的立法對我國教育行政的啟示

    Abstract: 被形容為「教育憲法」的教育基本法，八十八年六月四日上午在立法院院會三讀通過立法(立法院，民88)。根據教育基本法揭櫫為保障人民學習及受教育之權利，確定我國未來教育的主軸、方向與精神，並以法律為前提，提供法源及公平的救濟管道，強調人民為教育的主體，國家、教師、父母並共同負起教育協助義務，教育的目的更由傳統的傳道授業，明確納入民主素養、法治觀念、藝術涵養、強健體魄，及思考判斷與創造能力等現代化方向，值得國人加以重視和肯定。回顧教育基本法的立法經過，立法委員翁金珠指出：「將近六年的歷程，教育基本法的立法將是台灣教育史上的重要里程碑，符合教育福利國、教育社區化、教育民主化的精神」(台灣新生報，民88年6月5日，三版)。教育基本法的立法在我國最高主管教育機關，前後經過郭為藩先生、吳京先生、林清江先生三任教育部長，並經多次的研商、討論、公聽會、說明會，及朝野協商共識，找出制定教育基本法之關鍵重點：以學習權為核心的教育人權、彌補憲法有關教育條款的不足、容納國際先進教育理念的共識、作為仲裁爭議的準則、落實民間改革意願，作為進行立法之依據。對照教育基本法之立法經過的我國政治、社會、經濟、文化環境，正符合了『重要本質理論』的原則。因此，『教育基本法』的內容與效果，是當前對教育行政影響最直接、最根本的重要主題。以下分別從：壹、教育基本法的理念體系架構分析；貳、教育基本法的重要本質理論分析；參、從重要本質理論看教育基本法的立法精神與各條條文內容；肆、教育基本法的立法對我國教育行政的啟示等四方面來加以探討。
