    Title: 大學英/外語文課程、外語畢業標準檢定 辦法與補救課程之通盤檢討

    Abstract: 本研究之目的在於檢視本校英/外語畢業門檻所衍生出的問題，分別從學理
    面、公平性、法理面、與執行面等四個層面探討。本文將逐一論證：一、英/外
    語畢業門檻之本質為「不教而誅」，不僅違反大學教育之基本精神，甚且違背大
    學法所賦予大學之自治精神；二、外語畢業門檻在諸多層面上流於恣意，包括各
    個外語測驗之間、外籍生之間、外籍生與本籍生之間、與不同系所之間，都無法
    做到公平公正；三、此一法規有違背行政命令所應遵守的幾個基本原則（即適合
    性、必要性與法益相稱性），有違法之虞；四、在實際執行面上，「補救課程」的
    「後門條款」是一種技術性的欺騙；而且本校獨厚TOEIC 多益測驗代理商之事
    實也恐遭行政不中立之質疑。本文最終建議：本校校方應正視本研究所提出種種
    問題之嚴重性，儘速廢止英/外語畢業門檻，且應回到教育的本質，只有在提供
    學生適切且足夠的英/外語教育的前提下，方得給予合理的考核。
