    Title: 談教育基本法的立法對學校行政工作者的啟示

    Abstract: 被形容為「教育憲法」的教育基本法，八十八年六月四日上午在立法院院會三讀通過立法(立法院，民88)。根據教育基本法揭櫫為保障人民學習及受教育之權利，確定我國未來教育的主軸、方向與精神，並以法律為前提，提供法源及公平的救濟管道，強調人民為教育的主體，國家、教師、父母並共同負起教育協助義務，教育的目的更由傳統的傳道授業，明確納入民主素養、法治觀念、藝術涵養、強健體魄，及思考判斷與創造能力等現代化方向，值得國人加以重視和肯定。
    對照教育基本法之立法經過的我國政治、社會、經濟、文化環境，教育基本法的立法的牽動著教育實施與教育改革的脈動，迎接二十一世紀的到來，固定的學習方式、一陳不變的知識，已不足以應對時代的蛻變，學校教育改革聲浪波濤洶湧：教師會、教評會、家長會、民間教改等組織促使教育決策權力的重組；人本化、民主化、多元化、科際化、國際化指引了教育發展的方向；教育鬆綁、學習權的保障、父母教育權的維護、教師專業自主權的維護等理念搖擺著教育權利的平衡機制，使得學校組織文化及學校行政管理面臨前所未有的衝擊及必然面臨的挑戰。因此，學校行政工作者如何面對因應教育基本法立法之後學校行政工作的推動，似乎已成為我國邁向新世紀學校行政研究的焦點，因為教育基本法的內容與效力，是當前對學校行政工作影響最直接、最根本的依據。
