Title:	你的孩子不是你的孩子？家長「教育選擇權」範圍與內涵再思考

Abstract:	近兩三年來，〈教育基本法〉第八條第三項經常被引用作為「家長教育選擇權」並參與或引導學校教學方向的法源依據，最明顯的例子是有關學校性別教育的教學內涵等。本研究試圖從家長「教育選擇權」發展的歷史脈絡與概念內涵，重新爬梳並釐清家長「教育選擇權」的概念，並透過「脈絡」研究的觀點，從更廣大的立法脈絡、歷程、精神，去解釋條文的概念與意旨，重新思考〈教育基本法〉第八條第三項被認定的「家長教育選擇權」範圍與內涵。研究發現，家長教育選擇權其主要概念被宗教及家長團體挪用或誤用成是家長有權介入課程設計與教育內涵。〈教育基本法〉第8條第3項雖有家長得參與學校教育事務的條文，但其前提必須需先滿足教師之專業自主權以及學生之學習權、受教育權、身體自主權及人格發展權，而非漫無節制任非受過教育專業的家長介入。
